Nikon successfully resolves infringement claims in EDTX and obtains institution of IPR validity challenges of digital camera patents at PTAB

On behalf of Nikon Corporation, Jones Day successfully resolved a patent infringement action brought by Optimum Imaging Technologies LLC, a non-practicing entity, in the Eastern District of Texas alleging that Nikon’s digital cameras infringe four patents related to correcting aberrations and distortions in captured images. After presenting strong defenses, including an indefiniteness argument for which the Judge stated that he was “troubled” by the patents’ use of the claim term “optimize,” the parties settled on the eve of the claim construction hearing. The case was dismissed in May 2025. On behalf of Nikon, in February and April, 2025, Jones Day also successfully obtained institution of IPR proceedings challenging the patentability of each of the four asserted patents even after the PTO rescinded its 2022 Memorandum and the PTAB requested additional briefing on discretionary denial issues.
